Save the Bagobo-Tagabawa lumad, Save Tudaya!

It is what they will fight against till their last breath. "

The Bagobo - Tagabawa lumads, ancestral inhabitants of Sitio Tudaya in Sta. Cruz, Davao Del Sur are threatened to be displaced by the upcoming construction of a hydro-power plant.

A capitalist investment is not for public good, only for profit

The implementation of the P4.3 billion project of the Hydro Electric Development Corporation HEDCOR, Inc) owned by the Aboitiz Equity Ventures (AEV) started on March 2007 and is targeted for completion on 2009.

It is AEV’s largest power investment; and the worst nightmare that has ever dawned for the Bagobos living in the ten communities within Sitio Tudaya--- Balabag, Lower Pogpog, Sentro Pogpog, Mainit, Kolan, Tumpis, Mabuliyu, Baruring, Garuk and Katalelan.

The company plans to tap the Tudaya Falls, the highest in Mt. Apo Natural Park, and the Sibulan River for the water and energy supply for the said hydro power plant.

Tudaya is a sacred ground

But the Tudaya waterfalls is part of the Bagobo’s ancestral lands. Their forefathers have tended it for hundreds of years, only to lose it to a corporation’s ambition for huge profits.

It is a most sacred ground; the home of their gods. It is where they celebrate their religious and cultural life as a people; only to awake one day to find the fishes dead and Mt. Apo overtaken by cemented roads, bulldozers and drilled with holes.

Who will bear the environmental consequences?

The village is located in an environmentally critical area. Mt. Apo is in fact declared as a government protected area, allegedly for the protection of the flora and fauna within it. Hence, the construction of a hydro-power plant, privately-owned at that, is a big contradiction to the whole essence of environmental protection that the government projects.

“This is a land given to us and I hope it will remain as sacred as it is.
If they will really insist on it, let them face the gods.”



The hydro-power plant will affect the flow of the waterfall because of the construction of a small overflow dam just a kilometer away from the falls. Rivers and the waterfalls will be altered, affecting the livelihood of the lumads who depend on the rivers for food.

Inundation and flashfloods when leakages happen puts the whole Sitio Tudaya in grave danger.

Apo Adoc and the members of his community denounce the free prior and informed consent (FPIC) allegedly acquired by HEDCOR. He said that all the consultations were done outside their village which is a disrespectful to their people.

“HEDCOR and some people who are NOT residents here insisted on the project. It was approved with the supposed assurance that we will not be affected by it. But we will be affected by it.”

LUMADS: The fight against HEDCOR's hydro-powerplant is never over

Tagabawa Lumads under the SinÅb-badan ka mga Lumad Bagobo Mekatanod (SILUBAME) are not giving up the fight against the Tudaya Hydro-Powerplant, a multi-million project of the Hydroelectric Power Plant (HEDCOR) in Sitio Tudaya, Brgy. Sibulan, Sta. Cruz Davao del Sur.
We have brought our opposition against HEDCOR's hydro-power plant before the local government of Davao del Sur. We hope that they would heed our just demands. All we want is for our inherent rights over our ancestral lands to be respected, said Roger Limokon, SILUBAME Chairperson.

On February 2, 2008, the Peoples Consultation, a dialogue with the provincial board of Davao Del Sur was initiated by SILUBAME. Provincial Board Members Molina and Bello of the province's Committee on Environmental Concerns and Committee on Tribal Affairs attended the consultation. Strangely, the military soldiers also showed interest in joining the event, in fact together with more than a hundred military soldiers, a certain Lt. Renin of the 39th Infantry Battalion actively participated in the consultation.

In the said consultation Hon. Bello promised that committee hearings will be aptly conducted based on SILUBAME's complaint that HEDCOR violated genuine consultation processes when it did not disclose to the whole community the adverse impacts of the project. The local officials also said they will review the memorandum of agreement between the community and HEDCOR.

The board members were toured around the almost 10- hectare head-pond being constructed above the Tudaya Elementary School . They cited the experience of Ormoc, Marinduque among others as tragedies wrought by private companies interest for profit.

According to the PASAKA Confederation of Lumad Organizations in Southern Mindanao , the construction of a hydro-power plant, within Tudaya falls, a sacred ground for the Bagobo -Tagabawa lumads violates their cultural and ancestral land rights. The project also violates environmental preservation since it is located in Mt. Apo , a declared protected area.

Mel Elio, PASAKA Chairperson said that according to the Technical Working Group which initiated the feasibility study of the project, water shortage after 20 years may arise. Other environmental impacts include the possibility of flash floods, endangering the school children and the communities below. The hydro-power plant will also affect land and water biodiversity and resources, contributed by the wastes from the plant.

During the consultation, more than 100 military elements from the 39th and 72nd Infantry Battalion have assembled in Sitio Tudaya. Lt. Renin of the 39th IB said a detachment of the 72nd IB will be built a kilometer away from the Tudaya Falls . According to local residents, additional elements of military soldiers were deployed and arrive in their area the day before the scheduled consultation. SILUBAME strongly believe the soldierspresence in the area was deliberately done to intimidate the people.

The militarization of Tudaya at the height of the Tagabawa lumads assertion of their ancestral land rights over capitalist interests shows clearly which master the military serves. Instead of siding with the people, they are used as instruments of violence in order to protect the profits of capitalists, Elio said.

Board Member Bello also challenged the presence of the AFP, saying it should not get in the way of the peoples political affairs. He encouraged the people to report instances of military abuse in the area.

Makatabang ba sa mga Lumad ug sa mga katawhan ang Upat (4) ka Bilyong Proyektong Hydro nga pagatukuron sulod sa yutang kabilin sa tribong Bagobo-Tagabawa sa Sta. Cruz?

Kung atong pagatukion og maayo, DILI MAKATABANG ANG MAONG PROYEKTO sa katawhan, gani makadaot kini ug maoy mahimong hinungdan nga padayunong mapuo ang kaliwatan sa mga lumad tungod sa mga mosunod nga mga rason nga nakalatid sa resulta sa pagduki-duki sa Komitibang nagtan-aw nga gimugna sa Munsipyo sa Sta Cruz:


1. Ang Proyekto nga hydro elektrik maka-apekto og kadaot sa kondisyon sa kalasangan ug sa yuta tungod kay ubay-ubay ang mga kahoy sa kalasangan ang maputol aron mahawan ang agianan para sa mga kagamitan para sa pagtukod sa hydro ug kinahanglan mahawan ang dakong lugar para sa mga istruktura nga pagatukuron.

2. Ang Tudaya falls usa ka sagradong lugar sa para sa Tribong Bagobo-Tagabawa tungod kay sa maong lugar man nila ginapahigayon ang ilang tradisyunal nga pag-ampo/ritwal.

3. Ang agas sa tubig sa falls maapektohan subay sa plano nga pagatukurong Weir 1-A pila ka kilometro gikan sa falls kung diin ang dagan sa tubig sa falls i-balhin sa mga dagko nga mga tubo padulong sa penstock ug padulong sa turbine para makahimo og kuryente.

7. Ang proyekto nahimutang sa usa ka kritikal nga erya tungod anaa kini sa sulod o sa nataran mismo sa Mt. Apo Natural Park, nga pinuy-anan sa giprotektahang hayop nga Philippine Eagle. Kining lugara usab adunay makasaysayanong tradisyonal nga interes tunogd kay ginapuy-an kini sa mga kulturanhong komunidad. Anaa pud kini nahimutang sa delikado nga mga bakilid nga dili haom butangan og mga istruktura.

8. Ang proyekto mahimong hinungdan sa pagkabanlas sa kayutaan, pagkawala sa natural nga sistema sa kina-iyahan ug pagkadaut sa tinubdan sa tubig nga sa umaabot nga panahon mas makahimo pa og dakong kadaut sa kinaiyan.

9. Pagkawala sa tinubdan sa tubig pinaagi sa paghawan sa mga watersheds nga muresulta sa pagkunhod sa underground o anaa sa ilalom nga tinubdan sa tubig.

10. Ang posibilidad nga mahitabo ang aksidental nga oil spill o pagkayabo sa lana panahong nga nagasurbey nga muresultaa sa pagkahugaw sa mga agi-anan sa tubig.

11. Posibiladad sa fuel spills o pag-usik sa mga gasolina gikan sa mga daskong makinaryas nga muresulta sa paghilo sa tubig, sa kahayupan ug sa mga tawo mismo.

17. Walay igong mga pamaagi/lakang aron mapabalik ang kaayuhan sa kina-iyahan o sa lugar pag-abot sa panahon nga biyaan na kini kay dili na mapuslan ang tubig.

18. Ang posibiladad nga sirad-an o koralan ang palibot sa lugar sa Tudaya para sa pangseguridad nga katuyuan mamahimong muhikaw sa mga tawo o bisan kinsang tawo nga maka-adto sa Tudaya falls.

19. Ang katawhan sa Davao del Sur dili makabenipisyo sa kuryente nga mahimo sa hydro power plant tungod kay ang kuryente nga makuha sa Tudaya Falls ug Sibulan River idiritso man sa Davao City para mapuno ang kakulangon sa kuryente sa Davao light Power Corp.

Sa kinatibuk-ang pagtan-aw namong mga lumad, walay makuha nga kaayuhan ang katawhang lumad sa maong proyekto. Dili tinuod nga usa kini ka proyektong kalamboan tungod kay wala kiniy ikatabang kanamo. Magbutang hinuon sa dakong kadelikado ang kinabuhi sa mga katawhan tungod sa kadaut nga ibunga niini sa kina-iyahan ug mismo sa kinabuhi gayod sa mga lumad. Nakita sa among han-ay nga dili kalamboan alang sa lumad kundili kalamboan alang lamang sa mga hakog nga kapitalista ang maong proyekto.
